ORDINANCE NO. 1112 (2020)
AN ORDINANCE AMENDING SECTION 13.32.020 OF THE CRAIG MUNICIPAL CODE
TO ELIMINATE REFERENCES TO DOUBLE
CAPITAL INVESTMENT FEES FOR
WHEREAS, the City Council had contracted prior to the passage of Ordinance 980 (2008) to have a water and wastewater rate and capital investment fee study completed; and
WHEREAS, the study had recommended changes to the current tap fees which are to be renamed as capital investment fees; and
WHEREAS, due to the limited demand and usage occurring in parts of the water distribution system, it is incumbent upon the City Council to encourage new residential and commercial users in unincorporated areas of Moffat County that are adjacent to the City of Craig, to utilize produced potable water from the Craig Water Utility by tapping existing or approved and engineered water mains as needed and appropriate for these potential customers; and
WHEREAS, the City has received requests from potential customers in these unincorporated areas that were able to tap and utilize water sold by the Craig Water Utility but were discouraged from moving forward with their projects because the tap fees are required to be doubled for unincorporated areas; and
WHEREAS, the City Utility Director, City Building Inspector, City Attorney and City Manager recommend that we delete references in Chapter 13.32 requiring that we double the Capital Investment Fee for unincorporated residents and simply reference one set of tap fees for both water and sewer taps for future City and Unincorporated customers; and
WHEREAS, the City Council determines that it is in the best interest of the City of Craig and necessary for the preservation of the general welfare of the people of the City of Craig to maintain the health of the Water and Wastewater enterprise systems and funds.
The City Council deems it appropriate to publish the title of this ordinance, together with a summary of the ordinance and with a statement that the text is available for public inspection and acquisition in the office of the City Clerk.
PASSED, APPROVED AND ADOPTED AFTER PUBLIC HEARING ON SECOND READING THIS 11TH DAY OF AUGUST 2020 BY THE CITY COUNCIL OF THE CITY OF CRAIG, COLORADO.
